Terms of Service
Please read these terms before using NIS2Pathway.

1. Acceptance of terms
By creating an account or using the NIS2Pathway platform ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.
2. Description of service
NIS2Pathway is a compliance support tool designed to help organisations prepare for the EU NIS2 Directive. It includes a readiness assessment, action plan generator, risk register, evidence vault, and policy document templates.
No legal advice: NIS2Pathway is a practical tool. It does not provide legal advice and does not guarantee NIS2 compliance. Always consult a qualified legal or cybersecurity professional for compliance matters.
3. Account and organisation
You are responsible for maintaining the security of your account credentials. You must not share your password with others.
Each registered account is associated with one organisation. You are responsible for all activity in your organisation account, including actions taken by team members you invite.
You must provide accurate information during registration. You may not use the Service under false pretences.
4. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any regulations.
- Upload content that is illegal, harmful, or infringes third-party rights.
- Attempt to gain unauthorised access to other organisations' data.
- Interfere with or disrupt the Service or its infrastructure.
- Reverse-engineer or scrape the Service without permission.
5. Beta / early access
NIS2Pathway is currently in early access (beta). Features may change, and the Service may be temporarily unavailable. We appreciate your feedback and patience during this phase.
During the beta period, we may offer free or discounted access. We reserve the right to adjust pricing when the platform moves to general availability.
6. Subscriptions and billing
Paid plans are billed in advance on a monthly or annual basis. Payment is processed by Stripe. Prices are in EUR excluding applicable taxes.
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not provide refunds for unused portions of a billing period unless required by law — see our Refund Policy for details.
We reserve the right to change pricing with reasonable notice. We will notify you by email at least 30 days in advance of price changes.
7. Intellectual property
NIS2Pathway and its original content, features and functionality are owned by NIS2Pathway BV and protected by applicable intellectual property laws.
You retain ownership of all content you upload (evidence files, notes, custom policy content). By uploading, you grant us a limited licence to store and display that content to your authorised team members as part of the Service.
8. Data and privacy
We process your data in accordance with our Privacy Policy. By using the Service, you acknowledge that policy.
8a. Data processing agreement (GDPR)
When you use NIS2Pathway on behalf of your organisation, we process personal data (such as user names, email addresses and uploaded evidence) on your behalf as a data processor under the GDPR.
Organisations subject to the GDPR may request a Data Processing Agreement (DPA) by emailing privacy@nis2pathway.com. The DPA governs the conditions under which we process personal data on your behalf, in accordance with Article 28 of the GDPR.
9. Limitation of liability
To the maximum extent permitted by applicable law, NIS2Pathway shall not be liable for any indirect, incidental, special or consequential damages arising from your use of the Service.
Our total liability to you in connection with the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Termination
We may suspend or terminate your account if you violate these terms, with or without notice. You may delete your account at any time by contacting us.
11. Changes to these terms
We may update these terms. We will notify you of significant changes by email. Continued use after the effective date constitutes acceptance.
12. Governing law
These terms are governed by the laws of the Netherlands. Any disputes shall be subject to the exclusive jurisdiction of the courts of Amsterdam, unless applicable law provides otherwise.
